Legal malpractice may arise from an attorney's misconduct or failure to use adequate levels of care, skill or diligence in the performance of his duties, and occurs if he/she commits an error, omission or breach of duty to his/her client that results in a negative legal outcome or monetary loss for the client or a third party in a claim on which the client would have otherwise prevailed.
Attorney malpractice can take many forms. You may have grounds for a lawsuit if your attorney gives you improper legal advice, prepares documents incorrectly, fails to file a complaint or other documents, pursues excessive litigation at your expense, mishandles funds or commits a breach of attorney-client privilege, to name a few examples.
